Terms of Service

Effective date: 1 June 2026

1. Acceptance of Terms

By registering for or using the TACNow API and associated services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users of the Service, including individual developers and businesses.

2. Service Description

TACNow provides a programmatic SMS OTP delivery API. The Service allows you to:

• Send one-time passwords via SMS to end users
• Manage API keys and credit wallets per project
• View delivery logs and usage statistics

TACNow is a delivery-only service. We do not verify OTP codes on your behalf, and we do not store full phone numbers.

3. Credits and Payments

Credit-based billing. The Service operates on a prepaid credit system. Credits must be purchased before SMS can be sent. Credits do not expire.

No refunds. Purchased credits are non-refundable except where required by applicable law.

Pricing changes. We reserve the right to change credit pricing with 30 days' notice to registered users.

Insufficient credits. If your project wallet reaches zero credits, API requests will return an INSUFFICIENT_CREDITS error. No SMS will be sent.

4. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk messages (spam)
• Impersonate any person or organisation
• Transmit fraudulent, abusive, or illegal content
• Circumvent rate limits through multiple accounts or API keys
• Resell or sub-license access to the Service without our written consent

We reserve the right to suspend or terminate accounts in breach of these rules without prior notice.

5. API Key Security

You are responsible for keeping your API keys confidential. Do not commit live API keys to version control or expose them in client-side code.

If you believe a key has been compromised, revoke it immediately from the console.

6. Termination

Either party may terminate this agreement at any time. Upon termination, access to the Service is revoked immediately. Unused credits will not be refunded unless required by law.

7. Limitation of Liability

To the maximum extent permitted by law, TACNow is not liable for:

• Indirect, incidental, or consequential damages
• Loss of revenue, data, or business opportunity
• SMS delivery failures caused by telecommunications carriers
• Force majeure events

Our total liability to you shall not exceed the amount you paid us in the 30 days preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" without any warranty, express or implied. We do not guarantee uninterrupted availability, delivery success rates, or that the Service will meet your specific requirements.

9. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after notification constitutes acceptance of the revised Terms.
